Excavations, Undermining. The appeal was granted, an alleged violation of Section 1540(1) being vacated and the civil penalty of $240 being set aside.

It was the Division's contention that Appellant, a plumbing contractor, by the use of a vibrating spade in excavating a trench, had caused the collapse of an A-frame scaffold used by another employer on an adjoining building under construction.
