Reasonableness of Penalties, Failure to Abate Within the Allotted Time Period. The appeal was granted from the reasonableness of penalties imposed for failure to abate two violations for seven days beyond the date set for abatement. The Division had proposed $100 per day for each of two violations, for seven days, totaling $1,400. During the reinspection that resulted in the penalties, a 27-day extension was granted by the Division.
