EMPLOYEE, INDEPENDENT ACT AGAINST ORDERS.

The appeal from a citation alleging a serious violation of 1541(a) (inadequate shoring) was denied and the citation affirmed. The appeal was granted to the extent that the proposed penalty of $600 was reduced to $200.

The appellant had employees working in a trench 11 1/2 feet deep and 4 1/2 feet wide. The employees had been instructed to install a blower in the trench, an operation requiring approximately five minutes.
