[1] Citations, Delay in Issuance---[2] Burden of Proof, Preponderance of the Evidence Test. The appeal from two alleged nonserious violations, of five contained in two citations, was granted and those items dismissed.
(1) Appellant was allegedly in violation of 332.2 but Appellant contested the existence of the violation of the basis that the citation was not issued with reasonable promptness. The Appeals Board agreed and dismissed the citation.
