Evidence, Burden of Proof, None Offered. Appellant was cited for an alleged violation of T8 CAC Section 340, failure to display the Cal-OSHA poster. A civil penalty of $50 was proposed. At the hearing the Division made a motion to dismiss, stating its own inability to sustain the burden of proof. Dismissal was granted and the proposed civil penalty vacated.
