No New Evidence or Issues. The petitioner, the Division of Industrial Safety, alleged that the Appeals Board had abused its discretion by reducing a proposed penalty of $2,000 to $500 by failing to apply the jurisdictional rules contained in 8 Cal. Adm. Code, Sections 333-336 where the penalty for nonabatement had been set by regulation.
The Board found that the petitioner failed to present any new or compelling evidence nor did he raise any additional substantive issues.
