Employer, Duty to Guard Against Hazard Created by Another. Appellant operated a hotel which opened March 25, 1974. Appellant had required from his subcontractors that all work would be done in compliance with OSHA requirements. Appellant felt that he was being unfairly assessed and penalized if made to bear civil penalties for failures of the subcontractors.
