Withdrawal of Citation by Division. The appeal from an alleged nonserious violation of 8 Cal. Adm. Code 3213(c) was granted.
At the hearing, the Division moved to amend the citation and withdraw the alleged violation of 8 Cal. Adm. Code 3213(c) because, upon review of the allegation, the Division was satisfied that the conditions observed by the safety engineer did not constitute an unsafe working condition for Appellant's employees. The motion was granted and the appeal was granted accordingly.
