Employer, Sole Proprietor Not His Own Employee. The appeal from the amount of civil penalty proposed for an alleged violation of 8 Cal. Adm. Code 1592(a) was granted and the $90 penalty vacated.
Appellant was an independent owner-operator doing some trenching work for a plumbing subcontractor at a construction site. He was cited for failure to have a back-up warning device on his dump truck.
