Exposure to Hazard, Extent No Excuse for Violation. This appeal was denied and the violation of 4002(a) (failure to guard hazardous revolving parts) and its $35 penalty were affirmed.
An air compressor was located in a maintenance shop within a restricted area behind a locked gate. The outside portion of its hazardous drive pulleys and belts were guarded but only two-thirds of the inside parts were guarded. Appellant admitted the machine was serviced by its employees at a minimum of once a week.
