This appeal was denied. There were three nonserious violations established for which penalties were proposed. Two of these were repeat violations. All involved scaffolding being used by Appellant's employees during the erection of a masonry block building at the site. The scaffolding "swayed" and was not tied to the building (1644(e)), lacked some guardrails or endrails (1644(f)) and did not rest on proper baseplates (1644(d)).
The Administrative Law Judge affirmed the violations and penalties proposed of $1,140.
