[1] Excavations, Failure to Slope or Shore---[2] Violation, Serious, Defined.

The alleged violations concerned an open trench at the site 75 to 80 feet long and six feet deep. Two of Appellant's employees were observed within it. It did not have a ladder or other proper means of exit (1541(b)(2), nonserious) and was unshored (1541(a), alleged serious, affirmed nonserious). There was no penalty proposed for the former violation, the $600 penalty proposed for the latter violation was reduced and affirmed at $100.
