This appeal affirmed the two nonserious violations at issue and their proposed penalties of $35 each.

A violation of 4070(c) was established where a hacksaw and drill press lacked proper V-belt and pulley drives.

"...Although the machines were not in operation at the time of the inspection they were plugged in and could be turned on either purposely or inadvertently. Although the hacksaw was used infrequently and the drill press was not authorized to be used by an employee, there was access to their use. . . "
