"The Division made a request to dismiss Citation No. 1, Item No. 1, Instances Nos. 1, 7 and 8, which were the issues of this appeal, due to the fact that the safety engineer has been terminated from State service and is unavailable. There were eight instances cited under Item No. 1, and the three requested to be dismissed would in no way affect the alleged violation. The request was granted."
