Penalties, Reasonableness: Degree of Exposure; Safety Program as a Factor. Two separate citations were involved. The citation dated October 2, 1975 alleged a repeat/nonserious violation of 1644(d). The citation dated April 19, 1976 alleged a repeat/serious violation of 1768. The existence of these violations was not challenged; however, all the associated penalties were dismissed because the Division failed to introduce any evidence from which a reasonable amount could be established.
