Excavations, Failure to Slope or Shore [serious violation]. A serious violation of 1540(b) was established where an employee was working in a 12-foot deep excavation which was not properly shored. The proposed penalty was reduced, however, from $600 to $200, based on "appellant's impressive safety program."
