Two nonserious/repeat violations of 8 Cal. Adm. Code and their associated civil penalties were vacated on a showing by the Appellant that the Appellant was not the cited employer. The Division argued that the name used in the citation was the one offered by the Appellant at the closing conference, but the ALJ pointed out that no attempt was made to find out the true name of the employer and no amendments were offered up to or during the hearing.
