The Appellant was charged with 57 nonserious safety violations. On appeal was the existence of 39 of those alleged violations. Of the 39 alleged violations, only four carried proposed civil penalties, in an aggregate amount of $165. 23 of the 39 alleged violations were affirmed and 16 were vacated on various grounds including failure of the Division to show exposure of Appellant's employees to the hazard.
