Appellant, a bricklayer running a small home-based operation, had contracted as a masonry subcontractor at the site. Appellant was found in serious violation of 8 Cal. Adm. Code 1644(a)(6) (no guardrail). However, the proposed $600 penalty was reduced to $300 based on Appellant's earnings and small size.
