Penalties, Reduction for Serious Trenching Violation. Appellant was found in serious violation of 8 Cal. Adm. Code 1540(b) where an employee was in an unshored trench that was between five and six feet deep on either side of a culvert pipe. A penalty of $700 had been proposed for the violation, but the ALJ reduced it to $100.
