Digest of COSHAB's Decision After Reconsideration dated October 31, 1977, Docket No. 77-R2D3-221 and 222. Harold Mitchell, Chairman; Ford B. Ford and Mark K. Bowers, Members.

The Notice of Dismissal of the Appeals Board dated September 8, 1977, was affirmed.

"California Labor Code section 6602 mandates that a hearing shall be afforded an employer when he has filed a timely appeal with the Appeals Board. Labor Code section 6611(a) provides the Appeals Board with the authority to dismiss the appeal if the employer fails to appear at the properly noticed hearing.
