Maintenance and Repair. An alleged serious violation of 4000(d) was dismissed. Two nonserious violations were established and an associated penalty of $95 affirmed.
"Section 4000(d) requires that the `. . . controls shall be maintained in safe operating condition. . .' The position of the Division appears to be that since the semiautomatic position on the switch was not connected and had no function whatsoever, it was not properly maintained.
