Head Protection, While Using Powder Actuated Gun. Two general violations were established; no associated penalties had been proposed. Two alleged violations were dismissed.
The Appellant's foreman was installing light fixture supports in an overhead ceiling. A stud from the powder actuated gun he was using ricocheted and struck him in the head, knocking him off 12 foot high ledge on which he was standing. He was fatally injured.
