Excavations and Trenches, Exposure to Moving Ground, Explained. The decision of the ALJ in this matter (Digest 11,942) was affirmed.
"Title 8, California Administrative Code, section 1541(a) provides that all trenches, in all types of earth, are to be effectively guarded when more than five feet in depth.
"In the instant case, the evidence is uncontradicted that an employee of Petitioner was working in an unshored trench which was more than five feet in depth. These facts alone establish the violation.<</P>
