Two alleged general violations and $140 in proposed penalties were dismissed. The Appellant's site was constructed in accordance with code requirements prior to the effective date of the safety orders and was therefore, in accord with 2305.2(d), exempt from the cited electrical order. The second violation was vacated because the Division's evidence could not overcome Appellant's statement that the unguarded hacksaw had been removed from service.
