A serious violation of 2340.17(c) and a repeat/general violation of 2340.26(a) were each established. The respective proposed penalties of $300 and $3,000 were affirmed.

"The substantial evidence shows no provisions were made to protect the electrical equipment from physical damage. All the evidence in this case shows there was a live 220 volt power line within three feet of scaffolding which was not guarded against accidental contact.
