The matter was settled at the hearing by the Division's motion to withdraw the citation for an alleged Construction Safety Orders violation after it was stipulated that the work site was not a construction site but a warehouse. The Employer, in turn, stipulated that the citation was not arbitrarily and capriciously issued.
