An alleged serious violation of 3328(e) was set aside.

An overhead acid pumping apparatus had been erected on the oil rig at the site. Although everything else overhead had been chained (hobbled) to prevent falls, the swivel head, located approximately 32 feet above the floor of the drill rig, was not hobbled. Hobbling the swivel head, with the acid pumping unit attached would have created an explosion hazard.
