On its own motion, the Appeals Board set aside the ALJ's Order dated February 26, 1981, which permitted the Division to withdraw its citation and $500 proposed civil penalty for an alleged violation of 5208(l) and also permitted Employer to withdraw the appeal. The Board's decision was based on a finding that the Order did not accurately reflect what happened at the January 23 hearing.
