The Decision of the ALJ dated December 19, 1978 (Digest 13,035) was reversed to the extent that a $500 penalty for a violation of 5208(1)(2) (reporting asbestos use) was reduced to $100. The basis of the reduction was the Employer's lack of actual knowledge of the reporting requirements, coupled with the belief that work on a federal facility did not require compliance with state reporting requirements.
