The appeal was granted as to the alleged general violation of 1592(b)(1) (permitting audible automatic backup warning alarm for other than 2 1/2-yard capacity earthmoving vehicles). Also granted was the appeal of an alleged serious violation of 1644(a)(3) (base plates for stationary metal scaffold legs) and its $5 penalty where the Division was unable to establish exposure except by inadmissible hearsay evidence.<</P>
