Digest of COSHAB's Decision After Reconsideration dated May 27, 1982, Docket No. 78-R1D4-766. Harold Mitchell, Chairman; Mark K. Bowers and Charles Manfred, Members.

In this Decision After Reconsideration the Board affirmed the ALJ's Decision of December 11, 1978, which denied Employer's appeal of a repeat/regulatory violation of 5209(f)(1) (required operations reports for employer dealing with carcinogens) but which reduced the penalty from $5,000 to $1,000. The Board on its own motion ordered reconsideration of the part of the ALJ Decision which reduced the penalty. The Division filed an answer to the order.
