The Employer did not contest the existence of the alleged serious/repeat violation of 1540(b) (guarding excavations) or the serious violations of 1587.4 (hoisting cranes) and 1587.13 (safety latches on overhead loads). The only issue on appeal was the reasonableness of the assessed penalties totaling $1,590.
