This appeal was granted to the extent that the proposed $50 penalty for the alleged serious violation of 1646(b)(1) (guardrails on elevated work platforms) was set aside on evidence that Appellant had hired two construction employees only to remodel a building, that the Appellant had no construction experience but relied on the employees and that he had no intention of entering any business in which he would have to hire employees.
