Digest of COSHAB's Decision After Reconsideration dated May 31, 1984, Docket No. 78-R1D2-1474. Elaine W. Donaldson, Chairman; L. A. Harrington, Member.

A repeat/general violation of 1585(a)(1) (operator qualifications, powder-actuated tools) was affirmed. The Board held the violation established even without evidence objected to by Employer; it also rejected Employer's argument that the section is impermissibly vague and therefore unenforceable.

The cited section requires that an employee using a powder-actuated tool must receive training as prescribed by the manufacturer, and must carry a valid operator's card for the tool whenever he uses it.
