The Appeals Board affirmed the ALJ's Decision of April 23, 1979 (Digest 13,246). It denied the appeal from violations of 1621(a) (railings and toeboards), 1629(a)(4) (stairways and ladders), and 1636(b) (periphery railings - repealed).
The actual existence of the violations was not at issue before the Board, which considered only the Division's right to inspect and its effect on the validity of the citations.
