The Appeals Board affirmed the ALJ decision of November 8, 1979 (Digest 13,565) finding two serious violations of 6335(a), reducing one from repeat/serious. However, the Board ruled that the ALJ should have stricken the second separate $485 penalty proposed for the reclassified violation.
