A serious violation of 1592(b) (warning methods) was affirmed, with the proposed penalty of $300. At hearing, Employer conceded existence of the violation and the fact that it was serious. The appeal was limited to whether Employer should be held responsible for a defect in a leased grader, and the amount of the penalty.
