Digest of COSHAB's Decision After Reconsideration dated February 19, 1985, Docket No. 80-R2D1-1014. Elaine W. Donaldson, Chairman; Alfred H. Song, Member.

The Appeals Board affirmed the ALJ decision of February 3, 1981 (Digest 14,300), denying Employer's appeal from a serious violation of 4184(b) (guarding points of operation and other hazardous parts of machinery), with $240 penalty. The Board declined to consider, as tardily raised, Employer's attempt to offer in evidence the Division's administrative interpretation of 4184, which Employer contended would permit an alternate protection to guarding of its punch-riveting machine.
