The serious characterization of a violation of 4070(c) (guarding, belt and pulley drives) was affirmed, but the $160 penalty was vacated. The proposed $160 penalty for a serious violation of 4300(a) (circular rip saw) was affirmed. Seriousness of the 4070(c) violation and reasonableness of both penalties were the only issues on appeal.
