Digest of COSHAB's Decision After Reconsideration dated March 14, 1985, Docket Nos. 81-R4D5-893 and 894. Elaine W. Donaldson, Chairman; L. A. Harrington and Alfred H. Song, Members.

The Appeals Board affirmed the ALJ decision of October 15, 1981 (Digest 14,701), vacating alleged serious violations of 5157(a)(1) and (b).

The Board held that there was no violation of the confined-space safety requirements for employees working in a Los Angeles city sewer--that the Division failed to prove a sewage gas hazard, and Employer established a record of adequate ventilation.
