The Appeals Board affirmed the ALJ decision of July 22, 1985 (Digest 16,247), insofar as it reduced a violation of 341.1(i) (pertaining to notices required of annual permittees) from repeat/regulatory to regulatory and vacated a proposed $50 penalty.
However, the Board (after ordering reconsideration on its own motion) overruled the ALJ's construction of this safety order and held that holders of annual excavation permits must give the required notices of specific projects
