The Appeals Board reversed the ALJ decision of July 21, 1986 (Digest 16,719). The Board granted Employer's appeal from an alleged serious violation of 3203(a)(2) (accident prevention program).
An employee fell about nine feet from a large tool (an SMF) under construction. No fall protection was provided. Other testimony was offered that employees worked at 10- to 12-foot elevations without scaffolding or other protection.
