The Appeals Board reversed in part and affirmed in part the ALJ decision of April 23, 1990 (Digest 17,371). Reversing the ALJ, the Board granted an appeal from an alleged regulatory violation of 341.1(a) (permits). The Board denied an appeal from a serious violation of 1540(d) (excavations).
