Following a drive-by inspection of a construction site which contained a trench partly exceeding five feet in depth, Employer was cited for three general and one regulatory violations. At the hearing the Division withdrew the general violations, leaving on appeal citation for a regulatory violation of 341(a)(1) and a proposed $250 penalty.
