Digest of COSHAB's Decision After Reconsideration dated February 16, 1993, Docket No. 91-R2D2-557. Elaine W. Donaldson, Chairman; Michael R. Monagan and Bill Duplissea, Members.

The Appeals Board reversed the ALJ decision of January 30, 1992 (Digest 17,882), which had granted Employer's appeal of a serious violation of 3314(a) and a $2,000 penalty. The Board affirmed the violation, but reduced the classification to general and set aside the penalty. Reconsideration was on petition by the Division.
