The Division, following an accident inspection, cited Employer, a tree maintenance and removal company, for general violation of 3328(a), alleging that an employee operated a stump grinder in a manner which endangered his safety, resulting in serious injury to his foot. A $200 penalty was proposed. The Employer appealed only the penalty.
