The Appeals Board reversed the ALJ decision of October 8, 1993 [Digest 18,399] which had affirmed a violation of 1541 (e) and a $750 penalty.

Two employees were within a 24-foot-long by 8-foot-wide by 21-foot-high trench shield, in a 20-foot-deep trench, installing sections of 6-foot-long clay sewer pipe, each weighing 2,600 pounds. Pipe sections were lowered into the trench with an excavator.
