Employer was the subcontractor responsible for steel framing walls and covering the walls and ceilings with drywall at a hospital under construction. Following an accident inspection, the Division cited for a serious violation and proposed a $5,000 penalty. Employer appealed, raising the independent employee action defense and contesting the serious classification of the violation.
