Employer, an excavation company, was the subject of a complaint-initiated inspection, after which the Division cited for one regulatory and three general violations, proposing a total of $695 in penalties. Before the hearing, Employer withdrew appeal of two of the general violations (1509(a) and 1509(b), IIPP and Code of Safe Practices). The violations and an $85 penalty were affirmed by operation of law.
